  • You're separating and need to divorce, and to work out what happens to the home, savings, and pensions.
  • You and your ex have agreed how to split things and want it made legally binding.
  • You can't agree about money, or your ex isn't being open about their finances, and you may need the court's help.

How it works

  1. Step 1: Start the divorce

    £950 + VAT

We prepare and submit the divorce application. The divorce ends the marriage, but it doesn't deal with the money on its own.

  2. Step 2: Agree if you can

    £950–£1,250 + VAT

We help you reach a fair agreement through negotiation or mediation. If you agree, we turn it into a consent order for a judge to approve, usually without a hearing.

  3. Step 3: Stage 1: application and disclosure

    £4,500–£7,500 + VAT

If you can't agree, the case starts with an application to court on Form A, usually after a meeting with a mediator called a MIAM. You each complete Form E, a full statement of your finances, and at the first hearing (the First Appointment) a judge decides what else is needed, such as valuations.

  4. Step 4: Stage 2: FDR hearing

    £4,000–£7,500 + VAT

At the Financial Dispute Resolution (FDR) hearing, a judge gives a view on what a fair outcome might look like, to help you both settle. If you reach agreement, it can be turned into a financial order.

  5. Step 5: Stage 3: final hearing

    £6,000–£12,000 + VAT

If you still can't agree, a judge hears the evidence at a final hearing and decides how your money, property, and pensions are divided. The decision is set out in a financial order that is legally binding on you both.

How the court decides

There's no fixed formula. The court's first consideration is the welfare of any children under 18. It then looks at each person's income, earning capacity, property and pensions, their needs, the standard of living during the marriage, their ages, the length of the marriage, and what each of them contributed, including looking after the home and children.

Where there's enough to go round, assets built up during the marriage are often shared equally. Where there isn't, meeting needs comes first, especially housing for any children.

Why it's worth finishing the financial side

Without a financial order, your ex could make a claim against you in future, even years after the divorce. And if you remarry before applying for a financial order, you may lose the right to bring your own financial claims. A consent order or a court order gives you both certainty.

Frequently asked questions

Does getting divorced sort out the money?

No. The final order ends the marriage, but either of you can still make financial claims until a court order deals with them.

Do we have to go to court?

Not if you can agree. A consent order is usually approved on paper, without a hearing. Court proceedings are only needed if you can't agree, and you can still settle at any stage.

Is everything split 50/50?

Not automatically. The court aims for a fair outcome based on your circumstances, which may or may not mean an equal split.

Do I have to try mediation first?

Before applying to court, you'll usually need to attend a short meeting with a mediator, called a MIAM (Mediation Information and Assessment Meeting), unless an exemption applies, such as domestic abuse or urgency. The court also expects you to consider settling throughout the case.

What if my ex hides money?

You each have a legal duty to give full and honest details of your finances. If your ex doesn't, we can raise questions and ask the court to order them to provide documents. A settlement based on hidden assets can be overturned later.

When should I apply for the final order?

It's often safer to wait until your financial order is approved, especially where pensions are involved, because some rights can be lost once the marriage ends. We'll advise you on timing.
